MOTORCYCLE SERVICE REGULATIONS<\/strong><\/h2>\n\n

PART I \u2013 GENERAL TERMS AND CONDITIONS OF THE WEBSITE<\/strong><\/h2>\n\n

\u00a71. General <\/strong><\/h3>\n\n
    \n
  1. These Terms and Conditions define the rules for using the services of the MotoStrefa MS-Performance motorcycle service (hereinafter: the Website) and the online store at www.ms-performance.com<\/a>, hereinafter referred to as the Service Providers.<\/li>\n\n\n\n
  2. By returning a motorcycle, part or controller to the Service, you accept all provisions of these terms and conditions.<\/li>\n\n\n\n
  3. The service provides services in the field of diagnostics, mechanics, electronics, controller programming, tuning, key making and coding, as well as dyno measurements.<\/li>\n\n\n\n
  4. All rights to the Website and the online store, including economic copyrights, intellectual property rights to its name, its Internet domain, the store’s website, as well as to photographs, placed on the Store’s website (with the exception of certain logos and photos presented on the Store’s Website, the copyrights to which belong to third parties) belong to the Service Provider.<\/li>\n\n\n\n
  5. It is prohibited for the Client to provide illegal content and use by the Client of the Store’s website or other services provided by the Service Provider, in a manner contrary to the law, good morals or violating the personal rights of third parties. <\/li>\n\n\n\n
  6. The Service Provider declares that the public nature of the Internet and the use of services provided electronically – as in any case – may be associated with the risk of obtaining and modifying data by unauthorized persons, therefore the Client should use appropriate technical measures that will minimize the above-mentioned threats. In particular, use antivirus and identity protection programs for Internet users. <\/li>\n\n\n\n
  7. It is not permissible to use the resources and functions of the online store in order for the Client to conduct activities that would violate the interest of the Service Provider, i.e. advertising activities of another entrepreneur or product; activity consisting in posting content not related to the Service Provider’s activity; activity consisting in posting false or misleading content. <\/li>\n\n\n\n
  8. The information contained on the Shop’s website does not constitute an offer of the seller within the meaning of the Civil Code, but only an invitation to the Customers to submit offers to conclude a contract.<\/li>\n\n\n\n
  9. The Client may place orders in the online store via the Store’s Website or by e-mail 7 days a week, 24 hours a day.<\/li>\n\n\n\n
  10. The Client may choose the following payment methods: a) bank transfer; b) by payment card or bank transfer through an external fast payment system; c) cash on delivery; d) cash or payment card for personal collection; <\/li>\n\n\n\n
  11. The Client is obliged to examine the delivered consignment in the time and manner accepted for consignments of a given type. In the event of a loss or damage to the shipment, the Client has the right to request the supplier’s employee to write an appropriate protocol. <\/li>\n\n\n\n
  12. The customer has the option of picking up the ordered goods in person. Collection can be made on the Website during the opening hours indicated on the Store’s website, at the address: www.ms-performance.com<\/a>, after prior arrangement of the collection date via e-mail or by phone. <\/li>\n\n\n\n
  13. In the event that the Client or another person or entity considers that the content published on the Store’s Website violates their rights, personal rights, good morals, feelings, morals, beliefs, principles of fair competition, know-how, secret protected by law or on the basis of an obligation, they may notify the Service Provider of a potential violation. <\/li>\n\n\n\n
  14. The Service Provider, notified of a potential violation, takes immediate actions to remove from the Store’s Website the content that is the cause of the violation.<\/li>\n<\/ol>\n\n

    \u00a72. Taking orders <\/strong><\/h3>\n\n
      \n
    1. Orders are accepted on the basis of a written or electronic repair order.<\/li>\n\n\n\n
    2. The customer provides real contact details as well as vehicle details.<\/li>\n\n\n\n
    3. The service may refuse to provide a service without giving a reason (e.g. the condition of the vehicle makes it impossible to work safely).<\/li>\n<\/ol>\n\n

      \u00a73. Deadlines <\/strong><\/h3>\n\n
        \n
      1. The dates are set individually.<\/li>\n\n\n\n
      2. They are subject to change for independent reasons (e.g. lack of parts, failures, external factors).<\/li>\n\n\n\n
      3. A change in the deadline does not constitute the basis for claims for damages against the Website.<\/li>\n\n\n\n
      4. The lead time depends on the type of product ordered, its current availability and the place of shipment. The store carries out shipments from several warehouses located in Europe, which may affect the final delivery date. <\/li>\n<\/ol>\n\n

        \u00a74. Parts Materials <\/strong><\/h3>\n\n
          \n
        1. The service uses original, spare or used parts \u2013 as agreed with the Customer.<\/li>\n\n\n\n
        2. Parts provided by the Customer are assembled solely at the customer’s risk and without the Service warranty.<\/li>\n\n\n\n
        3. The Service does not provide a warranty for used parts. Used parts are installed solely at its own risk and without the Service warranty.<\/li>\n\n\n\n
        4. The vehicle\/components must be in a condition that allows the order to be completed and to work safely.<\/li>\n\n\n\n
        5. The cost of parts may vary depending on the Euro exchange rate on a given day, in which case the Client is informed about the overpayment or surcharge. <\/li>\n\n\n\n
        6. The shipping costs of parts are variable, which means that the shipping price for some goods is calculated only after payment for the goods, and then an invoice is issued for the shipping costs<\/s> for the shipping costs incurred. <\/li>\n<\/ol>\n\n

          \u00a75. Vehicle pick-up <\/strong><\/h3>\n\n
            \n
          1. The customer picks up the motorcycle within 4 working days of being informed about the completion of the repair.<\/li>\n\n\n\n
          2. After this period, a parking fee of PLN 150 net is charged for each commenced day.<\/li>\n\n\n\n
          3. It is the customer’s responsibility to thoroughly check the vehicle upon receipt.<\/li>\n\n\n\n
          4. After leaving the Website, no claims regarding visual damage or deficiencies are considered.<\/li>\n\n\n\n
          5. The service is not responsible for valuables left in the vehicle.<\/li>\n<\/ol>\n\n

            \u00a76. Payments <\/strong><\/h3>\n\n
              \n
            1. The payment for the service is payable no later than on the day of vehicle collection.<\/li>\n\n\n\n
            2. The release of the vehicle may be subject to full payment.<\/li>\n\n\n\n
            3. In the event of non-payment, the Service has the right to keep the vehicle as security for the receivables (Article 461 of the Civil Code).<\/li>\n\n\n\n
            4. The valuation of the repair in the event of resignation from its performance on the Website is payable \u2013 PLN 150. net.<\/li>\n<\/ol>\n\n

              \u00a77. Warranty \u2013 general conditions <\/strong><\/h3>\n\n
                \n
              1. The warranty is provided only for services performed in accordance with the manufacturer’s technology and for parts purchased and installed by the Service.<\/li>\n\n\n\n
              2. The standard warranty period is 3 months from the date of pick-up of the vehicle and applies only to labor, unless otherwise agreed in writing.<\/li>\n\n\n\n
              3. The warranty covers only the scope of the service\/part performed and does not extend to the entire vehicle.<\/li>\n\n\n\n
              4. Complaints are considered within 14 days from the date of delivery of the vehicle or part to the Website.<\/li>\n\n\n\n
              5. The warranty does not cover: natural wear and tear, damage resulting from improper operation, accidents, tuning, interference of third parties and consumable elements such as: clutch, brake pads, rubber elements, suspension seals, bearings.<\/li>\n\n\n\n
              6. The condition for the complaint is the delivery of the entire motorcycle.<\/li>\n\n\n\n
              7. The costs of transporting the vehicle to the Service are covered by the Client.<\/li>\n\n\n\n
              8. The warranty expires, m.in, in the event of interference by third parties, independent alterations, failure to perform the required inspections after repair. <\/li>\n\n\n\n
              9. Contact with the Website is possible only from Monday to Friday from 9:00 a.m. to 5:00 p.m., excluding holidays, public holidays and holiday periods.<\/li>\n\n\n\n
              10. New parts installed by the Service are covered by the manufacturer’s warranty, hereinafter referred to as the Guarantor.<\/li>\n\n\n\n
              11. The Warrantor is solely responsible for the parts warranty. The manufacturer decides on the method of warranty implementation, in particular on repair, replacement of parts with a new one or refund of money. The Service has no influence on the Guarantor’s decisions or deadlines for their implementation. <\/li>\n\n\n\n
              12. The warranty period for new parts is 12 months (1 year) from the date of purchase, unless the manufacturer has specified a different warranty period in the product documentation.<\/li>\n\n\n\n
              13. The manufacturer’s warranty does not cover damage resulting from improper use, improper installation outside the Service, interference by third parties or use inconsistent with the intended purpose or recommendations of the Manufacturer. <\/li>\n\n\n\n
              14. All elements, parts, accessories, etc. purchased through the online store or stationary at MotoStrefa Jakub Nowak are guaranteed one year. <\/li>\n\n\n\n
              15. The Client is aware that any intervention \/ repair incompatible with the technology of the manufacturer m.in. ECU programming is associated with the immediate loss of the warranty by the Manufacturer and the Client is not entitled to any related claims against the Service. <\/li>\n<\/ol>\n\n

                PART IX \u2013 DETAILED RULES OF MS PERFORMANCE<\/strong><\/h2>\n\n

                \u00a78. Programming and electronics <\/strong><\/h3>\n\n
                  \n
                1. The Client is aware that during the programming of the controller, events beyond the control of the Service may occur, which are beyond the control of the Service (voltage failures\/spikes, software errors, errors of programmer suppliers).The Service is not responsible for failures or damages resulting from these events or as a result of the actions or interference of third parties. <\/strong><\/li>\n\n\n\n
                2. When sending controllers (without a vehicle), it is not possible to check the correct operation of the engine \u2013 the necessary calibrations\/adaptations are on the customer’s side.<\/li>\n\n\n\n
                3. Refunds for online file modifications are only possible until the file is sent.<\/li>\n\n\n\n
                4. ECU calibration complaints are only considered after the entire vehicle has been delivered to the Service.<\/li>\n\n\n\n
                5. The customer is aware that any interference with the ECU will void the factory warranty and is not in accordance with the repair technology provided by the manufacturer.<\/li>\n\n\n\n
                6. In the case of outboard motors, failure to achieve a higher top speed is not the basis for a complaint.<\/li>\n\n\n\n
                7. ECU calibration is not only about the top speed \u2013 it includes engine performance, throttle response, rotational ranges, unit safety.<\/li>\n\n\n\n
                8. The programming of some ECUs involves opening them \u2013 the Customer accepts the risk of damage and loss of warranty and waives any claims against the Service.<\/li>\n<\/ol>\n\n

                  \u00a79. Dyno and tuning <\/strong><\/h3>\n\n
                    \n
                  1. The motorcycle must be fully technically operational, without leaks, with an efficient drive and brakes.<\/li>\n\n\n\n
                  2. During testing\/tuning, the motorcycle is subjected to maximum loads \u2013 the Client accepts the risk of failure and waives any claims against the Service.<\/li>\n\n\n\n
                  3. The service is not responsible for failures or damages caused during the tests.<\/li>\n\n\n\n
                  4. Damage to the motorcycle resulting in the destruction of the dyno \u2013 costs up to PLN 140,000 are covered by the Client.<\/li>\n<\/ol>\n\n

                    \u00a710. Fuel system service (carburetors) <\/strong><\/h3>\n\n
                      \n
                    1. The client pays for the work done regardless of the effect of the first attempt.<\/li>\n\n\n\n
                    2. If the carburetors need to be replaced, the customer covers the cost of new and re-service.<\/li>\n\n\n\n
                    3. Cause: Prolonged downtime leading to damage to the carburetors.<\/li>\n\n\n\n
                    4. The actual condition can only be assessed after cleaning and trying to set it up.<\/li>\n<\/ol>\n\n

                      \u00a711. Brake system service <\/strong><\/h3>\n\n
                        \n
                      1. The service uses only new, full-value parts.<\/li>\n\n\n\n
                      2. Used parts can be used at the customer’s request \u2013 the customer accepts the risk of failure to function properly and safety risks.<\/li>\n\n\n\n
                      3. The Service is not responsible for the operation of the system in the case of using parts that are used or incompatible with the Manufacturer’s technology.<\/li>\n<\/ol>\n\n

                        Part X. Returns of goods \u2013 exclusions<\/strong><\/h2>\n\n
                          \n
                        1. The store sells products intended only for professionals<\/strong>, who have the appropriate technical knowledge and experience necessary for the proper use of the offered tools, devices, software and accessories.<\/li>\n\n\n\n
                        2. In particular, the following are not subject to return or withdrawal from the contract:<\/strong>\n
                            \n
                          1. goods made to special order<\/strong>, imported at the Client’s individual order, including products sent from warehouses located outside the territory of the Republic of Poland,<\/li>\n\n\n\n
                          2. electronic goods<\/strong>, including m.in diagnostic devices, programmers, controllers, interfaces, electronic modules and products containing electronic components, <\/li>\n\n\n\n
                          3. Brand products:ShiftingControll,AlienTech,Piasini Engineering,SportDevices,Andreani,\u00d6hlins,OBDLink,TEXA,Innovate Motorsports,<\/strong><\/li>\n\n\n\n
                          4. computer programs, software, licenses, subscriptions, activation codes, updates, and any digital products<\/strong>, including those provided electronically or requiring activation, registration, or assignment to you.<\/li>\n<\/ol>\n<\/li>\n\n\n\n
                          5. Returns can only be accepted for products that:\n
                              \n
                            1. does not bear any signs of use,<\/li>\n\n\n\n
                            2. are in original, factory and intact packaging,<\/li>\n\n\n\n
                            3. are not opened, activated, installed or modified,<\/li>\n\n\n\n
                            4. They have complete equipment, accessories and documentation.<\/li>\n<\/ol>\n<\/li>\n\n\n\n
                            5. The store reserves the right to refuse to accept a return if the goods have signs of use, tampering or have been returned in packaging other than the original one.<\/li>\n\n\n\n
                            6. The Store is not responsible<\/strong> for damages, defects or damages resulting from:\n
                                \n
                              1. incorrect or inconsistent with the intended use,<\/li>\n\n\n\n
                              2. lack of appropriate technical knowledge on the part of the Client,<\/li>\n\n\n\n
                              3. improper assembly, configuration, or interference with the product.<\/li>\n<\/ol>\n<\/li>\n\n\n\n
                              4. The Store’s liability is limited only to manufacturing defects<\/strong> of the product, in accordance with the applicable laws and the terms of the manufacturer’s warranty.<\/li>\n\n\n\n
                              5. The cost of the return is on the Client’s side.<\/li>\n\n\n\n
                              6. Electronic parts are non-refundable.<\/li>\n<\/ol>\n\n

                                \u00a713. Final provisions <\/strong><\/h3>\n\n
                                  \n
                                1. In unregulated matters, the provisions of the Civil Code apply.<\/li>\n\n\n\n
                                2. The Service Provider reserves the right to change the terms and conditions. All contracts for the provision of services by electronic means concluded before the date of entry into force of the new Terms and Conditions are executed on the basis of the Terms and Conditions that were in force on the date of conclusion of the agreement for the provision of services by electronic means.<\/li>\n\n\n\n
                                3. The Terms and Conditions are valid from the date of publication, i.e. 1.01.2026<\/li>\n<\/ol>\n\n

                                  \u00a714. Consent to the use of the image of the motorcycle <\/strong><\/h3>\n\n
                                    \n
                                  1. By using the services of the MotoStrefa MS-Performance Website, the Client agrees to take and publish photos and videos showing their motorcycle, vehicle or repair elements for the purposes of marketing, information and promotional purposes of the Website.<\/li>\n\n\n\n
                                  2. Publication may take place on websites, social media profiles, printed and electronic materials belonging to the Website.<\/li>\n\n\n\n
                                  3. The consent does not include the Client’s personal data or elements allowing for their direct identification (e.g. license plates, names, addresses).<\/li>\n\n\n\n
                                  4. The Client may withdraw the consent at any time in writing or electronically, which will result in the removal of the materials in future publications.<\/li>\n\n\n\n
                                  5. Withdrawal of consent does not affect publications and materials published before the date of withdrawal.<\/li>\n<\/ol>\n\n

                                    \u00a715. Service and warranty markings <\/strong><\/h3>\n\n
                                      \n
                                    1. Each shock absorber after service and each controller after any modification or programming is marked with the company’s MotoStrefa MS-Performance sticker.<\/li>\n\n\n\n
                                    2. The sticker is a confirmation of the performance of the service on the Website and a condition for granting a warranty or guarantee.<\/li>\n\n\n\n
                                    3. In the absence of a company sticker on the shock absorber, controller or other component \u2013 the warranty and warranty do not apply.<\/li>\n\n\n\n
                                    4. Removal, destruction or transfer of the sticker to another element is tantamount to the loss of warranty and warranty.<\/li>\n<\/ol>\n\n
